MAORI COUNCILS: GENERAL CONFERENCE.

Pursuant to notice under the hand of His Excellency the Governor, the delegates from the Maori Councils met in the Native Room, Parliament Buildinge, at 2.30 p.m. on Tuesday, the 29th August, 1911. Present. —Hon. Notices appointing the date and place of meeting of the Conference, and appointment of lhaia Hutana to be President, were read. The Hon. Mr. Ngata addressed words of welcome to the delegates, and commented generally on the work of the Councils, suggesting various matters for discussion. The President and other delegates replied. Secretary. —On the motion of Whakangaro Makahue (Kahungunu), it was resolved to ask Mr. Hei (Takitimu) to act as Secretary. Mr. Hei explained that lie had hardly recovered from a serious illness, and would prefer not to undertake the secretaryship, but he agreed to act on it being agreed that assistance would be afforded him. Minutes. —Minutes of previous meeting were read and confirmed. The Superintendent explained what had been the result of former recommendations. On the motion of Rere Neketini (Raukawa), resolved, That this Conference reiterates the resolutions passed at the last meeting of delegates, and asks that effect be given to those recommendations which have not yet been carried out. Hours «l Meeting. —On the motion of Rere Neketini (Raukawa), it was resolved to observe the following hours of sittings : Tuesday, 29th August, 2.30 to 4.45 and 7to 9 p.m.; following days 10 a.m. to 12.45 p.m., 2.30 to 4.45 p.m., and 7 to 9 p.m. Order Paper. —The question of order paper was discussed, and it was resolved to first ask the Hon. Mr. Ngnta if he would submit a precis of the proposed consolidating Act and of his address at the opening of the meeting. On the motion of Mr. Parata (Araiteuru), it was resolved that the meetings should be open only to delegates and members of Parliament. The Conference adjourned at 5 p.m. The Conference resumed at 7 p.m., all delegates being present. The Hon. Mr. Ngata attended, and explained that the time had been too short to comply with the request for /ire'ris of address, cVc. He suggested that the Conference should first draw up reasons for continuance of the Councils- under the Maori Councils Acts. Sub-Committee. —On the motion of Rere Neketini (Raukawa), it was resolved, that this Conference is strongly of opinion that the Maori Councils Act, 1900, and its amendments, together with the Councils appointed thereunder, should continue, and that the following sub-committee be appointed to draw up reasons in support of tin's contention--viz., the President, H. Hei, Parstene Ngata. Taraua Marmnaru, and Waaka te Huia. Komitis Marat. —A discussion arose as to the action a Council should take in the case of a Komiti Marae failing to take proper action in regard to breaches of the by-laws, and on the motion of Ilamiora Hei (Takitimu), it was resolved to submit the following questions for the opinion of the Crown Law Officer, viz. : — If ji Maori Council has delegated its powers, under the provisions of section 5 of the Maori Councils Amendment Act, 1903, to a Komiti Marae, can it consider and adjudicate on any offence against the by-laws committed in such marae district if the Komiti neglects or refuses to take action? Can any breach of a by-law be referred direct to the Maori Council by any person other than a member of a Komiti Marae from any Komiti Marae district where the Komiti neelects or refuses to take action? The Conference then adjourned at 9 p.m.

Wednesday, 30th August, 1911. The Conference resumed at l<) a.m., all delegates being present. Law Officers' Opinion. —The following opinion in regard to section 5 of the Maori Councils Amendment Act, 1903, was read :— Section 5 of Maori Councils Amendment Act, 190 S. 1 am of opinion that where a Maori Council has, under section 5 of the Maori Councils Amendment Act, 1903, delegated its powers to a Koiniti Maine, then it cannot consider and adjudicate on any offence against the by-laws in respect of which it has delegated its powers. The Council can either investigate breaches of by-laws and impose fines for such breaches, or it can delegate those powers to a Koiniti Marae; but both the Council and the Komiti cannot exercise those powers ai the same time. The Act does not provide for concurrent powers of dealing with breaches of by-laws. The Council can at an} - time cancel its delegation either in respect of all its by-laws or in respect of any particular by-law where it wishes to deal with breaches of that by-law itself. Where the Komiti neglects or refuses to take action in respect to the breach of a by-law, any person could bring the matter before the Council. If the Council considers it a matter in which it should take action, it should first cancel its delegation to the Komiti, and then it could investigate and deal with the matter itself. E. Y. It was resolved that the Conference adjourn till 2 p.m. to enable the subcummittee appointed to bring up reasons for continuance of Acts to prepare its report. The Conference resumed at 2.30 p.m., all delegates present. Sub-Committee's Report. —The sub-connmitee appointed to draw up reasons for continuance of the Maori Councils Acts and the Councils appointed thereunder brought up their report, of which the following is a translation : — The sub-committee set up by the delegates from the Maori Councils of both Islands begs to report to the Superintendent and the Conference as follows : — A. What are the advantages derived from the provisions of the Maori Councils Act, L9OO, and its amendments, or more particularly from the Acts which provided the Kingite Maoris resident in this Dominion with a measure of local self-government in their own district? So far as your committee can see it appears to be quite clear (hat the Maori people have great respect for the provisions of the Acts, and the various Councils and Komitis Marae are assiduous in carrying on the work for which they are authorized, as this witnesseth : — 1. All of the old Maori whales have been done away with, and have been replaced by wooden buildings in all the pas and villages. 2. All of the pas, residences, and tnaraes, together with their latrines, have been tidied up and improved. .'!. Drinking-waters at the pas and settlements have been made good. t. Animals have been shut off from the maraes. .">. Waters used for steeping Indian corn (kaanga piro) at pas and settlements have been absolutely abolished and the practice discouraged. (i. Grog has been prohibited from pas and settlements, and fines strictly imposed upon persons committing breaches of the Act in this respect. 7. Gambling of all kinds has been prohibited. 8. Tohungaism has been prohibited strictly, and is not carried on as formerly. !). The evils arising out of the holding of tangis have been greatly reduced, and are being gradually done awaj with. 10. Owing to the activity of the Komitis Marae and the Councils local troubles and petty crimes have greatly diminished. 11. Burial-places and everything in connection with the dead are being carefully attended to by the Councils. 12. Maori dogs are being registered as provided for in the Act. r lhe above facts sufficiently evidence the benefits derived from the Acts by the Maori people, but the following may be added : — 13. The latest census shows that the Maori population is increasing steadily. This is veiy important. I I The Maori schools are doing good work, and the attendance of children is on the increase. ' ■ 15. The Maoris are becoming more and more industrious in all parts. That is due to the Maori Councils Acts and the good work done by the various advocates for industry. Your sub-committee therefore earnestly asks this Conference to urge upon the Hon. Sir James Carroll, Native Minister, as follows: That the Maori Councils Act, 1900, and its amendments be protected in the interests of the Maori people of New Zealand, and that he gives his support to any measures calculated to improve and benefit the Maori people. Sufficient. (Signed by the members of the sub-committee.) On the motion of Taiawhio te Tan (Rongokako), it was unanimously agreed to adopt the above report. The Hon. Mr. Ngata submitted a number of questions, and the same were discussed and dealt with, as follows : — 1. Registration of Births and Deaths. —(fl.) Is it advisable that the Councils continue registration by their own Registrar, or should they take advantage of the European registration system? (6.) Is it the wish of the Maoris generally that registration should be compulsory, and tiint any neglect to register be met by imposition of fines?

(a.) Resolved, on the motion of Tahua Watson (Arapawa), That in the opinion of this Conference the powers as to registration of births and deaths should remain with the Councils. (b.) That registration should be compulsory, and be carried out on the same lines as the European registration, fines being inflicted for failure to register within a given time. 2. Local Option. —(«.) Is the system of each Council applying for a poll to be taken to remain in force? (b.) Is it advisable that the poll should be taken in inch Maori Council district at the time of general election of members of Parliament, or when J (c.) By whom should the cost of poll be paid? Resolved, on the motion of Here Neketini (Raukawa), (a.) That the matter of taking a poll on the subject of local option should be left to the option of each Maori Council, (b.) lliat a poll should be taken only in those Maori Council districts in respect of which application has been received, and only at the time of general election of members of Parliament for the Maori electorates, (c.) That the cost of such poll should be borne by the Crown. 3. Ways and Meant of providing Funds for Support of Councils.- -The Conference to discuss ways and means of adding to the funds of the Councils other than by collection of dog-tax and fines— (a) by means of tenement-tax; (b) by a percentage of rents being held back with the consent of owners of Native lands under lease. (Should Maori owners have power to call meetings, as is done under the " assembled owner " provisions of the Native Land Act. for the purpose of deciding the question of granting assistance to Councils out of the rents derived from their lands?); (c) by a tax on stock, similar to the sheep-tax of former times. After discussion, the Conference expressed the opinion that the principle of raising funds by means of (a) tenement-tax; (b) by voluntary donations out of nuts; ami (c) by a tax on stock, be affirmed. The matter of setting aside a percentage of rents to be decided by owners of lands under lease in a similar manner to matters dealt with under Part XVIII of the Native Land Act 1909—that is, by meetings of assembled owners. The Conference having continued to sit until the hour of '.1 p.m., with the usual 5 o'clock adjournment, then adjourned to 10 a.m. on Thursday.

Thursday, 31st August, 1911. The Conference resumed at 10 a.m., all the delegates being present. A number of motions were put forward by the delegates for discussion. On the motion of JJere Neketini it was resolved, with a view to shortening proceedings, that a sub-conmiittee consisting of Paratene Ngata (chairman), H. Hei, Tarawa Marumaru, Waaka te Huia, and the mover, with the Superintendent as adviser, be appointed to go through and systematically classify and report on the various motions now handed in. The Conference then adjourned to 2.30 p.m., to enable the sub-committee to bring up its report. At 2.30 p.m. the sub-committee brought up the following report : — Motion No. I.— Taiawhio te Tan (Rongokako): That one meeting in each year should be held in each Council district to consider matters of Maori custom, ami ways ami means of supporting the Councils. Such meeting to be under the control of the Council. Resolved, That this motion be referred back to the mover for further explanation. Motion No. 2.—Ratima Aperahama (Mangonui) : Thai each delegate k> supplied with a copy of the proceedings of this Conference. Resolved, That this is a matter for the Superintendent to see to. Motion No. 3.—Ratima Aperahama (Mangonui) : That it is advisable doctors should be appointed to attend to the Maoris. Resolved, That, as this refers to a matter of policy under control of the Health Department, this motion should not be reported on by the Conference. Motion No. 4-.—Ratima Aperahama (Mangonui): As to the dismissal of the Maori Sanitary Inspectors. Resolved, That it would be advisable for the Conference to express an opinion on this subject. Motion No. s.—Ratima Aperahama (Mangonui) : That the Government should be asked to put a stop to the system of issuing wholesale wine licenses to Assyrians and others within Maori districts. Resolved, That the Conference should discuss this question, with a view to making a strong recommendation. Motion No. 6.—Paratene Ngata (Horouta) : That power be given to deal with petty civil and criminal offences. Resolved, That, as there is a recommendation From a former Conference still before the Government, this motion be not further discussed. Motion No. 7. — Ratima Aperahama (Mangonui): That all communications, motions, &c, dealing with health matters should be published in the Maori language. Resolved, That the Conference should make a recommendation. Motion No. 8. —Te Pouwhare (Matatua) : That the boundaries of the Matatua Maori Council should be altered so as to include the Urewera Country and Waikare Moana. Resolved, That this is not a matter for the Conference, and that the mover should be advised to communicate with the Minister on the subject. Motion No. 9.—Heremia te Wake (Hokianga) : Questions as to local option, dog-tax, bylaws, duties of the Council, eve. Resolved, That, as this motion turns out to be a number of questions on subjects which are being discussed by the Conference, no comment is necessary. Motion No. 10.—Henare Werahiko (Te Arawa). Resolved, That as this motion is really a series of questions which should be explained by the Superintendent, no comment is necessary. Motion No. 11. —Waaka te Huia (Wairoa) : That information be given as to the Raukawa by-laws lately revised by the Crown Law Officers, with a view to bringing all other Council by-laws into line. Resolved, That the Conference expresses an opinion on the subject.

Motion No. 11a.—Waaka te Huia (Wairoa). Resolved, That as this motion is the same as No. 2 no comment is necessary. Motion No. 12.—Rawiri te Ruru (Pewhairangi) : As to reserving fishing-grounds and shelltish beds. Resolved, That, as this matter is dealt with in tho Acts and lias already been discussed, further consideration is unnecessary. Motion No. 13. — Taiawhio te Tau (Rongokako): On the subject of holidays. Resolved, That this question nee 1 not be discusser]. Motion No 14.—Paratene Ngata (Horouta) : As to bringing by-laws into line with the revised by-laws of the Raukawa Council. Resolved, That this be discussed with .Motion No. 11. Motion No. 15. —Paratene Ngata (Horouta): As to ancient burial-places (urupas). Resolved, That the Conference should discuss this important question. Report of sub-committee read and adopted. The Conference proceeded to discuss each motion in accordance with the sub-committee's recommendations. Motion No. 1 (Taiawhio te Tau): (referred to mover for explanation). —Various points were explained, and, on the motion of Paratene Ngata, it was resolved, That, as the questions involved are of too important a nature to be dealt with offhand, the mover should submit his views to each Council, in writing, for future consideration. Motions Nos. 2 and ■'! dealt with in accordance with sub-committee's report. Motion No. 4 : Sanitary Inspectors (Ratima Aperahama, Mangonui). —The mover explained the circumstances in his district, and it was resolved, That this Conference views with regret the decision of the Health Department to replace the Maori Sanitary Inspectors In Europeans, who. through not understanding Maori customs and sentiment, frequently cause unnecessary friction. It recommends, therefore, that the Department should be asked to consider the claims of suitable Maoris when appointments are being made. Motion No. 5: Wholesale wine licenses (Ratima Aperahama, Mangonui). —After discussion it was unanimously resolved, That this Conference is strongly of opinion the Government should be asked to abolish the system of granting Assyrians and others wholesale licenses to sell their wines within Maori districts. Motion No. 6. — In accordance with sub-committee's report, this was not discussed. Motion No. 7: Publication of health matters in Maori (Ratima Aperahama).—Resolved, That, with a view to the better understanding of health matters, this Conference is of opinion that the Health Department should lie urged to publish all communications and instructions in the Maori language. Motion No. 8. —In accordance with sub-committee's report, this was not discussed. Motion No. !• : Local option. Tins matter was fully discussed and resolutions come to. (See after question 2 submitted by Hon Mr. Ngata on Wednesday, -'SOth.) Motion No. It) (Henare Werahiko, Arawa): Questions explained In the Superintendent. On motion of Rere Neketini (Raukawa), it was resolved. That this Conference urges the Minister t" send the Superintendent or other officer periodically to each Council for the purpose of instructing them in the proper modes of procedure, and generally on all matters pertaining to Maori Council work. Motion No. 11 : By-laws (Waaka te Huia, Wairoa). Resolved, That this Conference deems it advisable that each Council should bring its by-laws into line with the Raukawa by-laws, which have recently been revised by the Crown Law Officers. Motion No. 12: Fishing reserves. Withdrawn. Motion No. I.'!: Maori holiday. —Withdrawn. Motion No. 11 : By-lnus. Withdrawn (dealt with in No. 11). Motion No. 15: Ancient burial-places (urupas) (Paratene Ngata).—After discussion it was unanimously resolved, That, with a view to the better protection of the ancient Maori dead, power should be given to the Maori Councils to consider applications for and issue permits to remove the bones from ancient Maori urupas to other approved places of burial. The Hon. Mr. Ngata attended and reviewed the work done at the Conference, and a hearty vote of thanks was accorded him for his address and kind attention to Council matters. Vofex of Thanks. — The various delegates having addressed the meeting, it moved and unanimously carried, That this Conference congratulates Mr. lhaia Hutana. the I , resident, on his long and successful connection with the Maori Councils, and accords him a hearty vote of thanks for the able and patient manner in which he has conducted the meetings of this Conference. A hope is expressed that the next Conference will see him iii his accustomed place in the chair. lhaia Hutana thanked the delegates for their kind wishes, and expressed his pleasure in presiding over such meetings, at which absolutely no friction hail occurred. He wished thorn success in their undertakings. The Superintendent was also accorded a unanimous vote of thanks for his assistance to the Councils and the Conference. Mr. Hackworth thanked the delegates for their kind expressions, and hoped that he would always be able to help them out of any difficulties which may arise from time to time. The Conference adjourned at 9.45 p.m. until 8 p.m. to-morrow, Friday, when it was hoped to meet the Hon. Native Minister and lav before Idm the various resolutions passed at the- Conference.

Friday, Ist September, 1911. The delegates met at 8 p.m. The Hon. Native Minister (Sir James Carroll), Hon. Mr. Ngata, Dr. Te Rangihiroa, M.P.. Te Parata, M.P., and a number of influential Maoris were present. The Hon. Native Minister officially received a precis of the resolutions passed at the Conference, and addressed the meeting at length, words of welcome being first addressed to him by the President of the Conference and others. The Hon. Mr. Ngata, Dr. Te Rangihiroa, Mr. Parata, \foihn Tunuiarangi, the President, and delegates also addressed the meeting. The Conference adjourned tine die.
