EDUCATIONAL RESERVES (RETURN OF).
Presented to both Souses of the General Assembly by Command of His Excellency. Resolution of the Legislative Council, dated 29th day of October, 1878. Resolved, " That, in the opinion of this Council, it is desirable that the subject of the educational reserves throughout the colony should be brought under the consideration of Parliament. "That the Ministers of Lands and Education should cause a report to be laid before Parliament, early next session, setting forth the following information: The position, extent, and estimated capital value of the reserves in each education district; their classification, as nearly as may be, into town, suburban, agricultural, and pastoral land ; the nature, term, and present income from existing leases, or other occupancy ; the governing bodies in which the lands are now vested respectively ; the probable income to be derived from renewed tenancy or occupation at expiry of existing terms ; and the method which it would be most expedient to adopt for the permanent management and disposal of the reserves." — (Hon. I have the honor, by direction of the Minister of Lands, to forward the subjoined copy of a resolution of the Legislative Council with reference to a report on the education reserves throughout the colony, and to request you to be good enough to furnish, with the least possible delay, the required information respecting the education reserves within your district. I send you herewith a supply of schedule forms, which will enable you to furnish the required information in a systematic manner. In entering the reserves in the schedule, you will be good enough to classify them separately, as follows :— 1. Reserves held by School Commissioners for primary education, as per the Arbitrators' awards under "The Education Reserves Act, 1877," published in the New Zealand Gazette No. 55,12th June, 1878 ; No. GB, 11th July, 1878 ; and No. 126, 16th December, 1878. 2. Reserves similarly held by School Commissioners for secondary education, exclusive of those secondary education reserves subsequently vested in other governing bodies by Act of Assembly for particular institutions. 3. Reserves held by School Commissioners under sections 19 and 20 of <: The Education Reserves Act, 1877," and any lands proposed to be set apart under the said sections, distinguishing separately those for primary and for secondary education. 4. Reserves held by the governing bodies of colleges, high schools, and other educational institutions by virtue of any Act of the General Assembly, or Act or Ordinance of a Provincial Council. 5. Reserves, other than the preceding, made at any time for educational purposes, and held in trust by ecclesiastical or other bodies, or by individuals. 6. Reserves made by Act of Assembly, or Ordinance or Act of a Provincial Council, or otherwise, for a New Zealand University, and reserves made for or held by the Otago University Council. 7. Reserves made for sites of school buildings, teachers' residences, playgrounds, gardens, glebes, &c, for particular schools. 8. Reserves (if any) made for educational purposes which cannot properly be included in any of the preceding classes. Subject to the above classification, the reserves held by each governing body or trust should be placed together, and under each class the different kinds of land specified in the resolution should be placed together —viz., (1) town land ; (2) suburban land ; (3) agricultural land; and (4) pastoral land. "With a view to obtain accurate information respecting the "Particulars of Lease or Occupation," it is recommended that you cause to be entered in the schedules, first of all, the whole of the particulars excepting those asked for under columns 5, 7, and 9. and then, in those cases in which you have any 1-C. 3.

doubt, send them to the governing bodies or trust to which they severally relate, with a request that they would as soon as possible supply all the information wanted in column 7 and immediately thereafter return the schedules to you for completion. If you have any difficulty in obtaining, within a reasonable time, the required information from any governing body or trust, you will be good enough to report on the case. On receiving the information as to the particulars of lease or occupation, you will be the better able to fill in columns 7 and 9, which you will necessarily have to do to the best of your own judgment, aided by such reliable advice and information as you may be able to obtain. In arriving at an estimate in each case of the " capital value," and of the " probable income to be derived from renewed tenancy or occupation," it would be necessary to follow, as nearly as circumstances will admit, some fixed and intelligible general principle. In regard to the capital value, your own local knowledge will enable you to arrive at a tolerably fair estimate of the present selling value of the several reserves, as if unencumbered with a lease, and excluding the value of buildings and fences under the lease. If it should be afterwards desired to arrive at an estimate of the capital value, subject to the encumbrance of the existing lease, the price fixed by you, and the data furnished by the sub-columns of column 7, will enable a calculation to be made. ■\Vith regard to column 11 ("Education District wherein situate"), I may mention that the definition of the several education districts is given in the Second Schedule to "The Education Act, 1877." It is not necessary that you should enter together the reserves in the different education districts, if this should in any way interfere with the other grouping already specified. It will be quite enough to enter the proper education district in column 11. You will please notice that the resolution also asks for information as to "the method which it would be most expedient to adopt for the permanent management and disposal of the reserves." No column has been given for this subject, as it is obviously unnecessary that a recommendation should be made in regard to each reserve. You will, however, be good enough to favour the Government' with your opinion on this point regarding different classes of reserves, in so far as you feel warranted or able to give an opinion. I need scarcely say that it is very desirable, that the return should bo furnished at the earliest possible date, consistent with completeness and accuracy. In addition to the New Zealand Gazettes, No. 55, 12th June, 187S; No. GB, 11th July, 1878; and No. 12G, 16th December, 1878, containing the arbitrators' awards under "The Education Eeserves Act, 1577," and the several Gazettes in which the setting apart or making of other education reserves is proclaimed, I may refer you to "lie-turn of Education Reserves," H.-35, printed in the Appendix to the Journals of the House of Representatives, 1870, Vol. ii. Referring to my circular of the lSih ultimo, respecting education reserves returns, I have the honor, by direction of the Minister of Lands, in addition to the information therein asked for, to request vou to be good enough to furnish him with a report containing— 1. A list and description of lauds reserved for educational purposes which have been sold under authority of any Ordinance or Act of a Provincial Council, or any Act of the General Assembly, or otherwise (specifying the particular object of the reserve) ; 2. The name of the Act or Ordinance, or other authority, by virtue of which the land has been sold : 3. The date or dates of sale, and the amount or amounts realized from such sale or sales ; 4. The manner in which the proceeds of such sale or sales have been invested or otherwise disposed of ; o. If invested for endowment purposes, the annual proceeds of the investment, and how the proceeds are disposed of; 6. Any other information which you may be able to furnish, and which you believe will be serviceable in placing before Parliament full and clear knowledge of the condition of the class of educational endowments herein referred to. In any case where you have not all the requisite information already in your possession, you will be good enough to apply for such information to the governors, trustees, or other body having the management of the reserves or endowments in questiou. Replies by Commissioners of Crown Lands to Circular dated the sth July, 1879. AUCKLAND. Sir,— Crown Lands Office, Auckland, 26th July, 1879. In reply to your circular letter No. 19, of the sth instant, requesting to be furnished with suggestions relative to the permanent management and disposal of the education reserves, I have the honor to point out that, so far as this district is concerned, the duties involved in the administration of these lands have hitherto been exceedingly slight, and have afforded but little opportunity of enabling a conclusive opinion to be arrived at as to the best method of management and disposal it would be advisable to adopt. I may, however, state that, so far as my experience has enabled me to form any judgment in the matter, the present mode of administration by the School Commissioners has worked very satisfactorily, and fully realized the object which their appointment was intended to secure ; whilst, at the same time, I know of no method the adoption of which would be attended with so little expense. I nevertheless think that when, in the course of years, these reserves come to be extensively dealt with, and the work resulting from their management and disposal is largely increased, the appointment, in connection with the Board of Education, of an officer specially charged with the duty of their administration will probably be found to be attended with greater advantage and convenience. TAEANAKI. Sin,— Crown Lands Office, New Plymouth, 21st August, 1879. In reply to your Circular No. 19, dated sth July, 1879, requesting suggestions as to permanent management and disposal of education reserves, after conferring with the Chairman and Secretary of the Education Board hero, I have the honor to report — Ist. That the present system of a Board of School Commissioners specially appointed for the management of the education reserves is working quite satisfactorily in this district. The Board here, at present, consists of the Commissioner of Crown Lands, the District Judge, and one other member nominated by His Excellency the Governor, and of two members elected by the Education Board—viz., the Chairman of that Board, and Mr. Parris. It appears desirable that the Commissioner of Crown Lands and the Chairman of the Education Board—the former having special knowledge of the reserves to be dealt with, and the latter being almost required by his position to have some knowledge as to revenue available from reserves —should be ex ojjicio members. A suggestion originating with the Secretary may bo mentioned: that, instead of apportioning one-fourth of the reserves for secondary education, it would very much simplify the matter if "The Education Keserves Act, 1877," could be so altered as to enact that one-fourth of the total revenue from the reserves should be set apart as endowment for secondary education. lam not aware of any other suggestion I can make on the subject. WELLINGTON. Sib,— Crown Lands Office, Wellington, Bth July, 1879. In reply to your Circular No. 19, of the sth instant, I have the honor to inform you that the management and disposal of educational reserves by the School Commissioners, under " The Education Keserves Act, 1877," so far as this Land District is affected, works well, and at very small cost. The Act above referred to has only been in operation for eighteen months —scarcely long enough to reveal any weak parts, should such be there. lam unable to suggest any alterations calculated to secure improvement for the permanent management and disposal of educational reserves. HAWKE'S BAY. Sib, — Crown Lands Office, Napier, 6th June, 1879. The School Commissioners' management of the reserves is, I think, very satisfactory. Since entering on their duties last year many reserves have been leased from which no revenue had previously been derived; and, as a consequence, the annual income has been increased more than one-half. A provision existing in " The Education Reserves Act, 1877," as to town reserves, might be extended to other classes, more especially to bush lands — in certain cases with advantage —namely, that power be given to lease for a longer period than seven years when deemed advisable. In reply to your circular letter, requesting me to furnish Government with any suggestions or recommendations I might he prepared to make as to the method which it would be most expedient to adopt for the perm&nent management and disposal of educational reserves, I have the honor to inform you, for the information of the Hon. the Minister of Lands, that I referred your letter to the School Commissioners, who at present have the management of the education reserves here, but have not received any reply. I am, however, given to understand by their Secretary that the present system is

CANTERBURY. (Memorandum.) Crown Lands Office, Christchurch, 21st July, 1579. In explanation of the mode of management of the education reserves by the School Commissioners, Canterbury, I enclose copy of the rules adopted by the Board for the conduct of its business, and of the conditions of the appointment of the Steward, and the definition of his duties. The salary paid to the Steward, to include travelling expenses, is £GOO per annum. He is the only salaried officer. The member of the Board of Commissioners who represents the South Canterbury Education Board is paid £3 3s. travelling expenses for each attendance at Christchurch. All lettings of reserves are made by public tender, with one month's notice, as provided by section 14 of "The Education Eeserves Act, 1877." I hold the offices both of Chairman and Treasurer, and do what would be the duties of Secretary if there were one. The present mode of management meets all requirements, and I am unable to suggest any improvement of it, provided that the offices of Chairman and Treasurer, or at least the former, are always held by some Government officer, whose duties lie in his office, and who is willing to do the routine work attaching to them. Rules. 1. The ordinary meetings of the Board shall be held at ChVistchurch on the second Tuesday in each month at 2 o'clock. 2. Special meetings may be called either by the Chairman or any two Commissioners by not less than seven days' notice given in writing to each member of the Board, or posted to his address. 3. In the absence of the Chairman from any meeting some member selected by those present shall preside thereat. 4. At all meetings of the Board three Commissioners shall form a quorum. 5. All questions coming before the Board shall be decided by a majority of the votes of the Commissioners present, and the Chairman shall have, in addition to a deliberative vote, a casting vote, in the event of the votes being equally divided. Any member dissenting from the opinion of the mnjority may require that his dissent, and his reasons therefor, be recorded on the minutes of the Board. (i. All business connected with the letting and occupation of lands shall be transacted at the Board, and the routine business by the Chairman, subject to such instructions as may be given by the Board. 7. One of the members of the Board shall be appointed the Treasurer of the Board. 8. All moneys received on account of the Board shall be paid to the account of "The School Commissioners " at the Bank appointed for that purpose ; and all payments shall, after being sanctioned by the Board, be made by cheque, signed by the Treasurer and one of the Commissioners. 9. The Board shall keep a record of its proceedings and of all business transacted by it.
Conditions of Appointment and Definition of the Duties of the Steward of Education Reserves in the Canterbury District which are vested in the School Commissioners. The engagement of the Steward to be at an agreed rate of salary per annum, to include travelling expenses, and to be terminable at the end of any month by notice in writing, signed by the Chairman on behalf of the Board, given three months previously. The Steward will not be permitted to accept other engagements or business, and will be required to devote himself exclusively to the business of the Board. He will take instructions from the Board, and for this purpose must be in attendance at every ordinary monthly meeting, and at any special meeting at which his attendance is requested. He will be required to advise the Board in respect to the letting and occupation of the lands with which they are concerned, the terms and conditions which should be made with intending tenants, and, generally, all other matters upon which his opinion may be requested. He will be required also to supply the solicitor with a description for the lease of any lands that may be about to be leased. It will be his duty to see that lessees or occupiers of lands observe and perform the covenants and conditions contained on their part in their respective leases or agreements, and to teport immediately

to the Board, if they are at the time sitting, or to the Chairman, if the Board should not be at the time sitting, any act or default clone or made by any lessee or occupier in contravention thereof which might at any time come to his knowledge. He will be required to visit and inspect, at least once in every six months, every holding to which are attached by the lease or agreement under which it is held covenants by the lessee or occupier as to fencing, building, draining, or otherwise, or conditions and limitations as to cropping or otherwise; and also to make a special inspection of any particular reserve or reserves at any time that the Board may require him to do so, and to report to the Board the result of every such inspection. It will be his duty to collect rents as they become due, and to deliver to the Board at each monthly meeting a statement in detail of the sums received since the last monthly meeting, and a similar statement of rents in arrear. All rents and other moneys which he may receive are to be paid to the account of " The School Commissioners," at the Bank appointed for that purpose, on the day on which they are received, or, if received after Bank hours, then on the following day. Provided that if the sum received ou any one day be less than £10 he may, in his discretion, retain it until other receipts have accrued amounting together to that sum; and provided also that on the day of each monthly meeting all moneys then in his hands shall be paid into the Bank. Concurrently with each payment to the Bank, he must send a memorandum of particulars to the Treasurer, together with a receipt signed by the teller. The Steward will be required to give a guarantee of fidelity in some approved Insurance Company in the sum of £1,000, the premium upon which will be paid by the Board. He must incur no expense on account of the Board, or enter into or make any engagement or commitment on behalf of the Board, without authority previously obtained. He must keep and produce to the Board all letters and communications received, and copies of all letters written by him connected with the business of the Board.
WESTLAND. Sir,— Crown Lands Office, Hokitika, 21st July, 1879. I have the honor to acknowledge the receipt of your Circular No. 19, of the sth instant, asking for suggestions or recommendations as to the permanent management and disposal of the education reserves included in the schedule sent by me on the 28th April, 1879, in compliance with your circular of the 18th February, 1879. As nearly all the reserves included in my return were therein stated to be vested in the School Commissioners, I did not make any suggestions as to the mode in which they should be dealt with, nor have I now any particular suggestions to offer. These reserves must for the most part wait until from some cause or other there comes to be a demand for land in their vicinity, and when that happens it will be for the School Commissioners to make the most of them they can, which I am sure they will not lie backward to do, for they are much in want of funds. The only general remark which I can make is that, as already stated in my report (sth December, 1878,) on the Kumara Education Reserve, it seems fair that the School Commissioners should get the fees for miners' rights, &c, exercised over their reserves. They are now in the position of either losing all revenue derived from mining on such reserves, or of harassing the miners by making them pay additional fees. If legislation is contemplated for the Kumara Reserve, I would suggest the desirability of making such legislation applicable to all endowment reserves on gold fields. I have, &c, J. The Governors of Canterbury College bate sold reserves as follows :— School of Technical Science, 12,2G9 acres, for £24,538; Superior Education, 1,037 acres, for £2.071; School of Agriculture, 39,258 acres, for £78,516 ; Girls' High School, 2,185 acres, for £4,370 : total, 54,749 acres, for £109,493. The money has been partly reinvested on securities, and partly expended on building*, and the purchase of other land for Agricultural Sloilel Farm. Iu Southland, Olago, 39 acres 3 roods 29 perches in Lumsden Township have been sold, for £3,141 10s., under "The Otugo Reserves Act, 1874." The money is to be reinvested, and the annual proceeds devoted to primary and secondary education.
