CLAIM FAILS
MONEY FROM WINNINGS BY HORSE (P.A.) WELLINGTON, This pay. A claim for £IOO brought by Alexander Jarden, a company director, against Raymond Eder, an agent and broker, was dismissed by Mr J. H. Hessell, S.M., in a reserved judgment in the Magistrate’s Court in Wellington. Jarden, who described himsef as a former leading horseman and trainer, claimed that he and Eder had half shares, in the chestnut filly Courtesy, and that when jie sold his share to Eder, the latter had paid him £IOO and verbally agreed to pay a further £IOO out of the horse’s first winnings. When the horse had -won, Eder denied making any such agreement, and refused to pay the £IOO. j ' _ Eder said that Jarden had never mentioned the second £IOO till the horse had Avon three years after the alleged promise. All he knew was that he was to pay £IOO to Jarden. No documents had been drawn up, and the transactions had been made verbally. . In dismissing the claim, the Magistrate said that Jarden had failed to discharge the onus of proof. A Washington message says that the
