Judgment for defendants was given in the Supreme Court to-day by Mr Justice Northcroft in the case in which Gerald Robert Maling sued Thomas Newburgh and Sons and the Mining House (N.Z.), Ltd., for £l5O, which plaintiff had paid into a mining syndicate. Plaintiff contended that no functioning syndicate had been formed and 1 , alternatively, that representations had been false.

“I have to hold that fraud was not proved, but in fairness to defendants I should say quite definitely that the case made by plaintiff himself shows no fraud,” said the Judge.
