BOND STREET CASE

JUDGMENT FOR THE CITY. [ Per Press Association.] WELLINGTON, June 27. Reserved judgment was delivered in the Supremo Court this afternoon by the Chief Justice Sir Michael Myers, in the case in whiyh the Wellington City Corporation, under an agreement dated 9th September, 1927, claimed £5OOO from the syndicate known as Bond Street, Ltd., for the widening of Old Customhouse street (now Bond street) and Parish street. In their statement of defence, Bond Street. Ltd., denied that the Corporation had fulfilled its obligations. It was also alleged that the Corporation had not proceeded with the work with due diligence, and the company counterclaimed for £lO,OOO damages. His Honour said that in his opinion it could not be said, having regard to the nature of the contract, and the circumstances generally, that the Corporation acted in any way unreasonably or failed to use due diligence. The Corporation was given judgment for the amount claimed. At the commencement of the trial it was agreed by counsel that only the Corporation’s claim should be tried, tho company reserving its right to go to trial later on the counter-claim.
