ALLEGED MANSLAUGHTER
OUTCOME OF MOTOR FATALITY. (Per Press Association.) AUCKLAND, July 12. A charge of manslaughter arising from a motor-car fatality in tho Great North Road on the evening of May 9th was heard at the Police Court to-day. John Leonard Lambert Smith, a young man, who was the driver of the car, was charged that by omission without lawful excuse to perform his legal duty ho did kill Maurice Jonson, aged eight, thereby committing manslaugher. The prosecution contended that the accused was| on the wrong side of the road, didi not sound his horn, and did not exercise sufficient precautions when he saw the deceased and his companion, a girl aged ten, crossing the street. Accused said he was on the right side' of the road, reduced his speed when he saw the children to six miles an hour, and swerved to the right to avoid the deceased. He pleaded not guilty, reserved his defence, and was committed for trial.
