W. Hogg (Mr Barnicoat) v. E. Nixon, £3 9s 7d ; amount to be paid within 14 days, in default seven days imprisonment.

DEFENDED CASE,

Cliai-lex Ciesswell and others (Mr Marshall) v. Henry Robertson and others (Mr Trisulwell), claim £2 7s lOd. The plaintiffs (Charles Crosswa'l, William Scott and Richard Bowenl say — (1) By agreement tinted 28th March, 1899, the defendants (Henry Robertson. Aithur Irvine and William Todd) agreed to indemnify the plaintills against all claims then outstanding in respect to tho Castlecliff Hall. (2) On the last-mentione 1 date the Chronicle Company had a claim of £1 18s 6d in respect of the Castleclilf Hall, and cal'ed upon the plaintiff, William Scott, to pay the same. (3) The plaintiff William Scott therefore gave notice of such claim to the defendants. (4) The defendants having failed to .satisfy the claim, Ihe Chronicle issued proceedings against the plaintiff to recover payment of the same. (5) The plaintiffs therefore gave notice of such proceedings to the defendants in order that they might defend the action. (6) The defendants declining to defend tlm action, the plaintiffs paid the amount claimed and costs (£2 4s 6d) into Court, and have further incurred 'cgal costs in coi.i.ection therewith amounting to 13s 4d.
