TREATING A RACEHORSE.
VETERINARY SURGEON’S CLAIM. A .case in which a fee of £6 6s for veterinary treatment given to the racehorse Te Oro was heard by Mr H. Y. Widdowson, S.M., at the Magistrate’s Court this morning. Plaintiff was H. E. Martin (Mr G. A. Connel), veterinary surgeon of 99, Oomvay Street, Sffrevdon. and the defendant. Charles Penetito (Mr P. P. J. Amodeo), farmer, of Hinuera, near Mntamata, North Island. Mr Connel said that Te Oro was brought down from the North Island to race at the Grand National meeting in 1921. Towards the end of July the horse developed a complaint which was likely to interfere with its racing ut the meeting. The horse was treated by plaintiff, and the treatment was so successful that Te Oro was able to race, and was placed tAvice out of three starts, winning stakes amounting to £llO. The horse was brought, down from tho North Island by Hugh Scully, who gave the order for its treatment by Martin. Plaintiff contended that there was a partnership betAveen defendant and Scally in connection with tho horse, and that he had the right to sue either partner. Mr Connel put in a document which had been lodged with the Racing Conference. and which he said showed that defendant and Scally were joint owners of Te Oro. Plaintiff said that Scally told him that defendant would pay the fee for his services, and that. Penetito owned the horse. Mr Amodeo contended that Penetito had leased Te Oro to Scally, and that the latter was responsible for plaintiff’s fee. The magistrate said he was satisfied there had been a partnership between Penetito and Scally. Judgment would be given for plaintiff for the amount claimed, together with costs.
