[Peb Pb-589 Assooiatzon»l WELLINGTON, Oct. 13. 'In the Supreme Court, the proprietor of the Victoria Hotel, at Petone, appealed againßfe a conviction by the Resident Magistrate for damage to a footpath, the existence of a cornio9 on the premic63 causing rain-water to drop on to the path and wear it away. His Honor said he waß of opinion that the information sufficiently charged an offence under Section 240, Subsection 77, of the Municipal Corporations Act. He was of opinion that an act within tbe Bub-seotion referred to had been disclosed, and that the erection of the cornice could nob be justified. He agreed with the finding of the Magistrate that an offence had been committed, but thought that defendant had' been hardly ' used. The conviction was affirmed, but; the penalty was reduced from £5 Is to Is, the defendant to pay coats.
