ORDER FOR RETURN By Telegraph—Press Association WELLINGTON. October 31. Holding that Gladys Ivy Cudby must have known the moneys given her by her husband were the proceeds of house-breaking by him, and his brother, Mr J. Miller, S.M., gave judgment in favour of the four plaintiffs, claiming from these three defendants moneys allegedly stolen by the brothers, and received by the woman, she knowing them to have been wrongfully obtained.

The plaintiffs were Thomas D. Richards, suing for £27. Arthur Edmondson also £27. Walter George Ross £B/7/-, George Campbell Clarke £5. Judgment was given in full for the amount in each case.

Mr Miller reviewed the whole of the plea made by Mrs Cudby as to innocence of wrong doing by her husband, and dealt lengthily with the references to thinking her husband whs a bookmaker, which was in conflict with her other statements of his making money by betting with bookmakers. From this and the fact of her knowing her husband’s past and the fact that he was out late at nights, and handing over considerable sums of money, there was a strong presumption that she kne’ T ' the moneys were stolen. She must have known that she was receiving moneys from her husband in nis continued career of crime, and in this way she lent support to this career and participated in the gains and associated herself in the scheme of crime.

Judgment was entered as prayed for against her separate estate.
