PLAINTIFF NON-SUITED By Tel eg ra DO —Press Association DUNEDIN, October 31. Represented by counsel, a British seaman who suffered injury while on the Byrd Antarctic Expedition, John Taylor Burt, claimed compensation in the Arbitration Court for injuries allegedly sustained during service with the expedition. Non-suit points that there was no master-servant relationship Burt being a joint venturer in the expedition, and that the J'cob Ruppe'rt was not a New Zealand ship were raised, while on the facts it was claimed by the defence that it was a trumped up tale.

Plaintiff was non-siuted, t ie Court hearng only one of defence’s wtnesses.
