GORMLEY v. MATTHEWS.
.MACJISTRATE'S DECISION. I'loo DAMAGES. His Worship gave his deterred judgment in the case Patrick (Jormley v. Joseph Matthews in which the plaintiff claims Lioo damages from defendant for inciting the Cliisholin Bros, to assault him. whereby he sustained senoils iniurv.
The Magistrate said: ''J am satislied that the plaintiff is entitled to judgment both <;n the facts and the law. As my decision is subject to a general appeal, following my usual custom I refrajn from giving any reasons or making any comment except one, that so far as the defendant is concerned a prosecution for perjury should be instituted, as lie has stated both in the Supreme Court .and here that the plaintiff was never assaulted by the Chisholms. Such a prosecution is a "'atter for the consideration of the police. The plaintiff claims £"200 as damages. Then' is lio doubt thai he h->s Mist-iiued a severe permanent injury. and been put to a certain amount
of expense for medical treatment and appliances. Judgment- will he for the plaintiff for £IOO with costs, £l2 195."
