BARRISTER IN TROUBLE.

WELLINGTON, July 22.
The Appeal Court to-day is hearing the motion of the' Canterbury Law Society to ,haye the name of Frederick Fuller, barrister, struck^off the rolls or to have him suspended on the ground of his failure to pay over money to a client and his failure to keep a trust account.' '•
In an affidavit Fuller admitted his failure to pay, but stated that the money £14 12s) had been paid since and that he had thought he was entitled to retain it, as it had been received in connection with an estate he was settling: He denied that he intended to retain it permanently. On behalf of Fuller, Mr Wilford urged that; s as there was no dishonest intention,' th« Cojirt should not make a rule absolute. The proceedings were a sufficient lesson to his client, and he would not be likely to make such a mistake again. The Court said. that but for the affidavit the case might have been dismissed, as the money had been returned. The affidavit, however, in the opinion of the Court made matters worse. Fuller was suspended £or six months and ordered to pay ten guineas costs.
