John Corder was charged with hay-ing-sold milk, through Ins servant, which was.not. up'to the standard required \y the Bale of Food, and -Drugs Act. Defendant, for whom Mr Harley appeared j pleaded not; guilty. ; Heniy Ooltman, Inspector under the Sale of Food and Drugs Act, stated that he' bought; a sample of milk.from the vendor.' He divided the sample into three parts—one, was given to the vendor, one, sent to the ..Government analyst, and one he kept. Previous samples from defendant had been of a very high standard, as results obtained by the Government Analyst showed. Cross-examined:. Tho night milk was put into a large can, and this into a concrete tank. He made no butter, and it -was six months 1 since he had sold any cream. The milk sent out on August 27th had not , been interfered with. Percy Corder, of defendant,'stated that ho delivered the milk. Tho sample was taken from three-quarters 1 of a gallon—all that was left in the can. James Bruce, instructor in agrieui- ; turo under thd Nelson Education Board, J said tho shaking would slightly mix the milk, but the top would be very rich and the bottom very poor. He analys,ed a sample, and tho results corres- ! ponded with the Government Analyst's. Mr Harley said there was no intention ,to deliver milk,below the standard. The fact was (that, the-top milk was very rich and the bottoni milk poor. Defendant stated that he now had an agitator, which kept , vtho milk stirred. ... He warned the lairymen that they must take steps to keep the, milk stirred and the cream distributed.l He would not in the future accept ignorance as ifn. excuse.
