ALLEGED ASSAULT.
D. Fowler was charged with assaulting David McCaughan by throwing him on the ground. The informant did not appear, and Mr. Harley, on behalf of defendant, applied for costs. The Magistrate said he could not grant the request, as there was no pro-1 vision for costs in the event of an informant not being in attendance to support a charge. If the charge was withdrawn costs "could-be- allowed. The information was dismissed.
