A BY-LAW CASE.
Samuel King pleaded not guilty to a charge of having ridden a horse on the footpath in Weka street, Leslie Ruffe]!, a contractor, stated that he saw defendant ride along the footpath some distance* William Childs stated that defendant rode along the edge of ' the footpath, about six feet from the fence and in line with the telegraph posts.-Plain-clothes Constable Wade stated that the footpath was five or six feet wide, but was not kerbed, nor was there any distinct gutter. Defendant, in evidence, stated that he rode some distance along the footpath. Some children were playing on the footpath, and one ran into th<> street. To avoid an accident he pulled in to the footpath, but immediately after pulled out into "the road. The Magistrate said that the evidence of the prosecution did not agree, and defendant gave a reasonable explanation which was sufficient to raise a doubt. The information would be dismissed. . - . •
