ALLEGED SLY-GROG. (Per Press Association.) Paliiatua, May 22. A charge brought against Michael Fitzgerald, licensee of\the Pest Office Hotel, Paliiatua, of exposing liquor for sale during prohibited hours, on March 17, was dismissed to-day. Four men were found in the liar on the Sunday in question. Defendant pleaded that lie was only "shouting" for his guests, and thought he had a right to do so. Mr L. G. Reid, S.M., in delivering his reserved judgment today, quoted two decisions of Justices Cooper and Williams, and pointed out that in Fitzgerald's case, when the police knocked at the side doer of the oar, the candle was blown out. Therefore, he did not think that there had been sufficient exposure. There must he exposure, he said, in the ordinary sense. He remarked that if the proceedings had been taken out in a different way the results might have been somewhat different;. illegal '"Fishing.'» Auckland, May 22. The killing of fish by setting off explosives in the water was admitted this morning at the Police Court by James H. Speedy, of Chelsea, who was charged with perpetrating the offence on January 29- and February 2. Accused was fined £5 and costs on the first charge, and ordered to pay 2Ss costs on the second. INCOME TAX CASE. Wellington, May 22. The, Court of Appeal to-day delivered judgment in the case Levin v. the Commissioner of Taxes. The Court unanimously held that the annuity of £SOOO, which was not charged upon the corpus of the estate, but was payable out of she estate, and which was unregistered, was liable to income tax. Costs amounting to £3O were allowed to the Commissioner of Taxes.
