APPEAL COURT.
WHERE JUDGES DIFFER. (Per Press Assoemtion ' Wellington, October 27. The Court of Appeal to-day gave its reserved judgment in the case of Schmidt and Bellshaw v. Greenwood. The Court unanimously held that the finding of fraud by the Judge in the Supreme Court ought to be reversed, as not being supported by evidence. The Court ordered tho questions of warranty and innocent misrepresentation to " be argued at next sittings. Costs were reserved till then. MISCARRIAGE OF JUSTICE. Wellington, October 27. Tho Court, in the reserved case of Rex v. Boakos, held that the conduct of the Crown Prosecutor and Pattio Kite did not raise a point of law which could be reserved under section 442 of the Crimes Act of 1908, and that the Court had therefore no jurisdßition. The Court, however, was of opinion that there was grave irregularity in the trial that must have influenced the minds of the jury, and that a miscarriage of justice had resulted. The Judges further, state that they were glad there was still a remedy by application to tho Gover-nor-in-Oouncil.

His identity was discovered through his cutting a finger on the glass of tho window lie broke to make an entrance. INCREASE IN CARTAGE RATES. Wellington, October 26. From November 1 next a new tariff for the cartage of all merchandise will come into operation. The city is divided into three radii, and rates have gone up to l-3d per ton and l-6d per ton, with wool 3d a bale and ■ld a bale, according to radius. The charges are net. The increased prices for horse feed and the present wages and conditions of work, it is understood, are some of the causes of tho advance, which is agreed to by thirteen city carrying houses. GENEROUS INVERCARG ILL. Invercargill, October 26. The local Salvation .Army during the self-denial week-collected iSTrO, with a few returns to come. A few weeks ago £415 was collected to wipe off the debt on the barracks—a total of £BBS for Army purposes collected in Invercargill during the three months. BLUFF HARBOUR BOARD. Invercargill, October 26. The Bluff Harbour Board has decided to invite applications for a resident engineer at £l5O a year.
