MAGISTRATE’S COURT THURSDAY
(Before Mr R. C. Abernethy, S.M.) The Magistrate delivered his reserved decision in the case in which Tappers Ltd. (Mr J. C. Prain) claimed £27/10/-, the balance of the purchase price of a motorcycle, from Arthur Herbert Grey, labourer, of Fairfax (Mr S. M. Macalister). The Magistrate said Grey signed a hire purchase agreement and three days later he repudiated the deal and returned the motorcycle. He had entered into the deal with his eyes open and had no right to call off the deal. The attitude of the plaintiff company had been that the purchase price must be paid and ownership of the machine pass to Grey. Mr Macalister had asked the Court to exercise its discretion to reopen the transaction, but he could not see any reason to do so. There was nothing harsh in the terms of the deal. The defendant had only rather spurious reasons for wanting to get out of the transaction. Judgment was given for the plaintiff for the amount claimed and £6/17/- costs. Security for appeal was fixed at £B/8/plus the amount of the judgment.
