DAMAGES CLAIM FAILS

BRITISH BOXER WINS CASE. (United Press Assn—Telegraph Copyright.) (Rec. 9.30 p.m.) Sydney, June 12. The suit to recover £3OOO damages for alleged breach of contra: t brought by the All British Arena . Syndicate against Al. Foreman, the British lightweight boxer, ended to-day, the jury returning a verdict in favour of the defendant.

That two days before his fight with Blay, in December last, Foreman had demanded that he should be given the decision in the sixth round, was the allegation made by counsel before Mr Justice Stephen and a jury in the Causes Court. Foreman, it was stated, had insisted that the fight should, be “rigged,” and, in order to get him into the ring, the promoters seemingly agreed to the proposition. This, however, was never ..carried out, and, although Foreman claimed a foul in the sixth round, he was compelled by the referee to continue with the fight. He finally got the decision on points at the end of 15 rounds. Foreman was the defendant in an action brought by Albert Monro Crocker, John Roxen, Morris Curotta, Samuel Rosen, Joseph Goldstein, Henry Thomas Firkin, and Thomas Morris, members of the All British Arena Syndicate, which was formed for the purpose of promoting boxing contests. Plaintiffs sought to recover £3OOO damages for alleged breach of contract. Plaintiffs alleged that the defendant had refused to take part in a contest promoted by them, and also had declined to give a public exhibition prior to the date fixed for the contest as agreed upon. Plaintiffs also sought to recover £3OB 9/- which amount included the difference between £250 advanced by plaintiffs to defendant for the purpose of releasing Foreman form his contract with the National Sporting Club, and the amount actually paid by him, namely, £2OO. This claim also included an amount of £2Ol alleged to have been overpaid to defendant for his fight with Blay, and moneys advanced to Foreman. Foreman denied that he had agreed as alleged, and also pleaded that he was never indebted concerning the second claim.
