THE BOARD’S POWERS THE WAITAKI COMPANY CASE APPEAL COURT’S DECISION (Per United Press Association.) Wellington, October 29.The judgment of the Full Court in the appeal case Waitaki Dairy Company versus the New Zealand Dairy Produce Export Control Board, heard on October 19, is that the extensive powesrs of export control conferred on the Board by the Act cannot be limited in the way suggested by the plaintiff. The Board’s power of control does extend to this particular company. Absolute control applies to all dairy produce from New Zealand after a specified date. On the question that under section 13 of the Act the Board can assume control only of dairy produce actually in being—that is, after it has been manufactured—the Court was unable to decide, as members were not agreed. Two thought the Board was not entitled to assume control of any produce not in existence. The rest thought otherwise, and the only course was to further adjourn consideration of the case so that it might be brought before a fuller Court of the Appeal Court.
