MONTHLY SITTING An application for- a cancellation of an order for the maintenance of ! a child was granted R. W. J- Henry | (Mr. W. C. Hewitt). in the Magistrate’s Court on Monday, before Mr |W- H- Freeman, S.M- It was stated that maintenance had been paid at the rate of £3 per month until the child had reached the age of 16. A Smash. Up j A claim for damrCges was sought by A. W. Andrew, of Cambridge (Mr. Kingsford), against L- C. Frendrup, of Waihi (Mr. H- L. Boughton). The amount claimed was £IOO for damages to a car involved in an accident on the main Rotorua Road on the night of April 24. It was stated that D. W- McKay, a butcher, of Cambridge, had allegedly borrowed plaintiff’s car to travel to Rotorua for a fishing trip. - '" MieKay said he had seen r'rendrup’s car approaching and had dipped his lights l , but when the approaching car had been nearly abreast of him it had swerved in front of - him and hit. the left rear wheel with his left front mudguard. Both cars had somersaulted and had landed upside down half on and half off the side of the read. Plaintiff added that he was on his correct side. McKay said that after the accident W. J- Lillis, driver of Frendrup’s car, had told him that his lights had gone out, ll>ut they were still burning after the accident. W. L- Lillis, in evidence, said that McKay had approached him on his wrong side and he had been unable to avoid him. . The Magistrate reserved his decision.
