SENTENCE QUASHED
PUBLISHER’S CONVICTION AN AMAZING DOCUMENT SYDNEY, Dec. 8. The High Court to-day allowed the appeal of Francis Devanny, publisher of the Workers’ Weekly, against his conviction arid sentence of six months’ imprisonment. The conviction was quashed with costs against the Federal Croivn Law authorities. The court described the information as an amazing document, calculated to embarrass the trial, and held that the averments were insufficient in law to sustain the allegations against Devanny.
The defendant was charged under the amended Federal Crimes Act dealing with communism, with soliciting contributions to an alleged illegal organisation, the Communist Party of Australia. The char-re arose out of an appeal for funds issued through the Communist organ, the Workers’ Weekly.
