CLAIM FOR DAMAGES
JURY ALLOWS MEDICAL EXPENSES. - CHRISTCHURCH, August 26. Gordon Melton. Gunn, a dentist, is the defendant in a claim for damages totalling £BO3 being heard in the Supreme Court before Mr Justice Adams and a jury. The claim arose out of an accident that occurred in Papantir road on Sunday, February 22, when John Priest, aged 77, was knocked down and injured. Priest, who is a retired farmer, is the plaintiff in the case. Negligence is- denied. The jury faund, in answering the questions put by his Honor, that the defendant had not been going too fast, that he had his ear under control; that he had not kept a proper look-out, and that he had not failed to give warning of his approach. At the same time the jury found that tire plaintiff had not failed to keep a proper look-out, but had been- guilty of. contributory negligence in attempting, in the circumstances, to cross the road. The jury disallowed the claim for damages, but allowed medical expenses. Judgment was reserved.
