RAILWAY CROSSING FATALITY
£I9OO DAMAGES AWARDED. WELLINGTON, Juno 4. Maud Barbara Canning, of Wellington, was successful in her petition for damages in connection with the death of her husband, John Edward Canning, at Porirua railway crossing in October of last year. The jury awarded her £IOOO damages, to be divided between herself and her two children. Deceased was driving a motor lorry, and collided with the north-bound WeilingtonAuckland express, the injuries sustained proving fatal. The sum claimed was £2OOO. The jury' considered that the train was travelling at excessive speed; that the whistling was satisfactory; that a warning bell should be installed at the crossing; and that Canning exercised reasonable care when approaching the crossing. On behalf of petitioner, Mr Kennedy moved for judgment in favour of suppliant on the jury’s findings, and this motion and a cross-motion by the Crown for judgment or for a nonsuit were adjourned for further consideration by Mr Justice Salmond.
