SYME VERSUS THE KING

WELLINGTON, April 28. The Appeal Court is engaged to-day in hearing argument in tho case of Syme v. the King, which was removed from the Supreme Court to the Court of Appeal. • In 1917 a high flood occurred in the Clutha Rivar in the neighbourhood of the Catlins railway. The railway authorities made an opening in the embankment. The petitioner ''alleges that the work was so improperly and negligently done that the flood 'waters did him, considerable damage. The Crown alleges that the embankment constituted an artificial obstruction to -.the natural flow of the flood waters; that the Grown was under no obligation to maintain the obstruction; that no more water flowed on to the petitioner's land than would have done if the embankment had not existed; further, that if the cut had 'not been made the railway embankment would have been carried away with the same consequences to the petitioner. -Mr John MacGregor and Mr R .Stewart appear for the petitioners, and Sir John Salmond. Solicitor-general, and Mr W. C. MacGregor; K.C., for the Crown. Argument is proceeding.
