THE RECENT EPIDEMIC.
REGULATIONS CHALLENGED. AUCKLAND, December 20.
Legal argument as to the validity of the orders closing the hotels and prohibiting the sale of liquor during the epidemic occurred in the Police Court to-day, when certain licensees were prosecuted for haviujr sold-liquor during the time mentioned. Counsel for the. defendants maintained—(l) Assuming that the warrants issued by the Government be good, it was necessary to prove that the Minister of Public Health had approved of the exercising of the powers to close the bars; (2) that thm powers given to the health officers were too extensive; (3) that there -had been a delegation of his powers by the Governor-Gen-eral, and that such a delegation was not authorised by Parliament; (4) that the - Governor-General's warrants were able, in that their score was such as\ to prohibit tho sale of liquor for any - pose, even by chemists in cases of life tad _, death; (5) that the notices issued to thm ; licensees did not show upon their faces that they were approved by the Minister. Judgment was reserved.
