LEGAL ACTION AGAINST MOTORISTS IN BRITAIN WHO SOLD NEW CARS

Rec. 8 p.m. LONDON, Dec. 22. Motorists numbering 7500 in Britain who have sold their new cars almost immediately after purchase will have legal action taken against them for “ breach of covenant ” by the British Motor Traders’ Association. In 1946 the association introduced a system by which purchasers of new cars had to sign an agreement not to resell within a certain time of purchase. Failure to comply with the covenant rendered the purchaser liable to pay the association “damages” amounting to 45 per cent, of the purchase price.
The association was successful in a trial case in the Chancery Division yesterday, which, according to the association’s secretary, cost between £IO,OOO and £15,000.
