APPEAL COURT.

WELLINGTON, July 18. In Rex v. Ford, a bigamy case, the Appeal Coui;t held that .the question whether there was sufficient proof of previous marriage ought to 'have been left to the jury, and that Mr Justice Cooper was wrong 'in directing an acquittal. The court therefore ordered the verdict of acquittal to be set aside, and granted a now trial.
. The case Ross v. Cassells was an appeal against the conviction by Mr Riddell; S.M., of Dave Ross, of Wellington, under section 30 of "The Gaming Act, 1908." Appellant posted a treble betting card to respondent Cassells, and the magistrate convicted him of publishing a (notification as to betting within the meaning of section SO, and decided in effect that the publication to one person constituted an offence under the section.' Tho Full Court held that a conviction in that form could not Bo supported, but it held that the inference was that the card was printed for circulation among appellant's customers, and that the magistrate was justified in finding that.such a circulation had taken place, that there had been, therefore, a publication of the circular within the meaning of tho section and to convict accordingly. The court further held that if a conviction had bean drawn up stating the offence was the publishing of a notification it ought to havo been amended so as to state that the offence waa the publication of a circular, but not to any particular individual. The appeal, therefore, was dismissed. Costs (£lO 10s) were allowed to respondent.
