RESIDENT MAGISTRATES COURT.
Friday, FErmiuitY 5. (Before Mr E. H. Carew, R.M.) D. Benjamin and Co. v. Andrew Black (Ashburton).—Claim L7O 'Is 9d, for goods.—Judgment for plaintiffs by default, W*. It. Frost and Co. v. C. White (as one of the partners of the Caxton Printing Company)—claim L 2, for work done ; and counter claim, White v. Frost—Ll 10s, for two blocks supplied.—Mr Adams appeared for Frost, and Mr Stanford for White. —It was agreed that the claim and the counter claim should be heard together.—The claim by Frost wits for two blocks which he had prepared and had handed to the Caxton Company for sale, one of which blocks had been sold and the other had been used as an advertisement in the Theatre Bulletin. The parties contradicted each other as to the verbal agreement regarding the terms on which the blocks were placed with the Caxton Company for sale. —His Worship, in giving judgment, said it was admitted that one of the blocks was sold, so that there could be no defence regarding that portion of the claim. The evidence also showed that the Caxton' Printing Company had wrongfully used Mr Frost's property by printing the blocks in the Theatre Bulletin. Judgment would be for the plaintiff Frost for 30s and 10s paid into court, with costs; and in the other claim, White v. Frost, the plaintiff would be nonsuited.
