CLAIM FOR DAMAGES

SETTLED BY AGREEMENT,

An accident occurred at Port Chalmers on January 25th last on hoard tho . Transport -——, whereby John Ourror, boilermaker, died two days iater. Deceased was employed with others to do certain repair work on the transport, and at the time ot the accident was under orders of the vessel’s officers, although lie was the servant of -Messrs Stevenson and Cook, Ltd., of Dunedin. Acting under the instructions of tho second engineer, he entered the craukpit, and while ho was there tho machinery was set in motion suddenly and without warning, with the result that tho crank-shaft revolved rapidly, striking Curror and causing fatal injuries. As deceased was injured in the course of his employment by -Messrs Stevenson ana Cook, Ltd., that company was liable to his widow tinder the Workers’ Compensation Act, but, acting on legal advice, she proceedings lor £2OOO damages against tho Crown., under tho Crown Suits Act, . claiming on behalf of herself and two children.

Mr. P. J. O’Rcgan, who acted for Mrs Ourror and her children, now authorises the statement that the case has been the Crown agreeing to pay £IOOO damages and £25 costs. Accordingly tho amount agreed upon has been paid into court at Dunedin, where judgment will bo taken by consent, and tho fund apportioned by the court as between the widow and children.
