CHARGE DISMISSED
ASSAULT BY HUSBAND "ACTION WAS JUSTIFIED" A charge of assaulting Charles William Russell on November 25 was admitted by John Edward Eugene Robinson, motor mechanic, aged 29 (Mr. Fraser), before Mr. J. H. Luxford, S.M., yesterday. Sub-Inspector McNamara said accused was separated from his wife. On the night of the offence he found tho complainant in his wife's home and assaulted him. The complainant was still in hospital. Counsel said complainant was pestering accused's wife, although ho was himself married, with a family. Accused warned him three times, at his wife's request, to leave her alone. When ho found complainant there on the night of the assault naturally a brush followed. The magistrate said that if accused was asked by his wife to evict complainant, the assault was justified, and the plea should have been one of not guilty. The charge was dismissed.
