CLAIMS FAIL
Reserved judgment on three claims by the inspector of awards against the Petrous Tile Company (Auckland), Limited, based on alleged breaches of the Northern industrial district concrete workers' award, has been delivered by Mr. Justice Tyndall. The department claimed a penalty of £lO in respect of each of three employees of the firm, which, it was alleged, had failed to pay the men in conformity with the award. His Honor said one of the claims had been withdrawn during the hearing. The first caso rested primarily on the interpretation of a clause in the award. The Court accepted the interpretation submitted by counsel for the defendant company in respect of this claim and held that the plaintiff had failed to show that the second worker was employed as a moulder's assistant. Judgment was given for the defendant company.
