ALLEGED NEGLIGENCE.
MOTORIST NOT GUILTY. FATALITY NEAR CHRISTCHURCH. [BY TELEGRAPH. —PRESS ASSOCIATION.] CHRISTCHURCH, Wednesday. In the Supreme Court to-day Leslie Norman Mcintosh was charged with negligently driving a motor-car on the main North Road, thereby causing the death of George H. Garbutt. The Crown Prosecutor said that about 11 o'clock on the night* of January 25. Garbutt, a chemist, of.Kaiapoi, was killed' near the northern approach to the Waimakariri Bridge. Garbutt, who was riding a motor-cycle, passed a taxi going from Christchurch and was 50 yards ahead going over the bridge. The taxi-driver saw a motor-car coming from the opposite direction, and this car, a witness would say, was on the wrong side of the road when the crash occurred. Accused's car did not stop, but continued on to crash into the taxi. The accused, when interviewed after the accident, said that he did not feel very well, and there was a 6mell of alcohol in his breath. Accused said ho was driving along the road when the motor-cyclist approached and swerved into him. The jury returned a' verdict of not guilty and Mcintosh was discharged.
