COLLISION WITH TRAM.
MCTOR-BUS DRIVER FINED.
DEGREE OF CARELESSNESS.
A sequel to a collision between a motor, has and a tramcar in Symonds Street, oil December 5, was heard in the Polico Court yesterday, when Robert G- Rhodes (Mr. Terry) was prosecuted by (lie Auckland City Council (Mr. A. H. Johnstone) for dangerous driving.
Mr. Johnstone said a tramcar was proceeding down an easy grade at from 12 to 15 miles an hour. A bus on the St. Heliers Bay service, driven by Rhodes, passed tho train and cut in front. The rear of tho bus struck tho front platform of the car and wrecked tho controls.
The motorman of the tram estimated the speed of the bus at 25 miles an hour. He said thero was considerable traffic in the vicinity at the time. Similar evidence was given by other witnesses. For the defence, Mr. Terry submitted the accident was not due to excessive speed or negligence. Defendant stated he was passing the car at a moderate speed, when lie drew level with a horse-drawn lorry. One of the horses swerved into tho path of the bus and witness was forced to incline on to the tramline to avoid colliding with the horse. Mr. Poynton held that defendant 3iad exhibited a degree of carelessness and imposed a fine of £1.
