MAGISTRATE'S COURT

FRIDAV, FEBRT7ARY 14, 1913 V (Before Mr J. S. Evans, S.M.) DEFENCE PROSECUTION'S. The police proceeded against .several Territorials for failing to render personal service, as required by the Defence Act. Sergt. Kelly prosecuted, ami the Defence Department was represented by Captain Bum. Chas. E. Kitching. who did not appear, was convicted and fined 20s, and ordered to pay 7 s costs, for failing to attend a parade on 24th January last. W. A. Newport, who pleaded guilty, stated that he had been in Takaka, and therefore could not attend. Sergt. Kelly said defendant should have his company officer of his change of address. A Territorial could put in parades in any part of the district, and it would be entered in his record book. It was a breach of the regulation if a change of address was not'notified to the authorities. The Magistrate; said it would be advisable to make it more generally known thai Territorials tould parade, at, the nearest drill centre. Convicted and fined 20s, and ordered to pay 7s costs. Defendant had been previously convicted on January 13th last on a previous charge. Norman Keith Roughton, who had | been convicted and fined on January ! 24th last, pleaded guilty, but statedI that since that date he had been under medical treatment, and produced a medical certificate to the effect that he was unfit to attend parades. He had informed his company officer to this effect. Captain Burn 'said the Department had received no such certificte. In answer to the Magistrate, Captain Burn said the defendant had to pay for such certificate. The Magistrate remarked that it was rather hard if a man had to pay for producing a medical certificate. It was only reasonable, that the Department's doctor should be able to give a certificate without cost to the man wanting it. Captain Burn pointed out that had defendant come to him he would have'scnt him to a medical officer. When 'Territorials were known to be sick they were excused from drill, and did not have lo product" a medical certificate. I The Magistrate ii'n, form-ed defendant I that his medical certificate was dated 13th February, whereas he had been ' charged with' being absent from drill on the 24th January. Defendant said he had been under 1 medical attention since he had been previously fined. The case was allowed to stand down until 3 p.m. to give defendant an op-, /porttmity of obtaining a medical certificate as' from 24th January last. On the Court resuming defendant was convicted and fined 10s, with 7s costs. 1 Gordon Henry Cunningham pleaded guilty to the charge, but stated that ho was living at Bronte, and ft was diflicnlt to get to parades owing to the static of a portion of the road. Captain Burn stated that Bronte was practically an exempted area at present. In answer to a question, defondanti said he was not aware that he had to notify the.Department of his change of address. The Magistrate said Territorials must learn the. ""requirements of the Act, and convicted defendant, ordering him to pay 7s cosrs. BREACH OF SHOP AND OFFICES ACT. The Inspector of Factories (Mr Tyson) proceeded against George McConchio (manager for Hannah and Co.) under Section 3 of the Shop and Offices Act, with, on the 31st January, employing a shop assistant after 6 p.m. , The Inspector stated that ho had found I the assistant at work dressing a window ! on the evening of the day in question. f No application for a permit had -, been I made. ~',.■ Defendant said he was under the nn- ! pression that so long as an assistant waa I over 18 years of age, and was paid time and a-quartety there was no need, to I apply for a permit. ._■'.' -Convicted and ordered to pay "iz costs,'
