INTOXICATION CHARGE
William Ure was charged in tho Eketahuna Police Court on Friday with being intoxicated while in charge of a car at Newman on February 13, and
after the hearing of evidence, the case was dismissed.
Mr. Marsack entered a plea of not guilty. Constable McCowan stated he had arrested accused on the day in question. To Mr. Marsack: Accused was medically examined about a quarter of an hour after his arrest.
Dr. E. M. Simmers gave evidence of examining accused, wno was in an exciteable state and somewhat unsteady. To Mr. Marsaca: He had not put accused through any actual tests. Un steadiness may have been due to mental excitement.
To the Magistrate: Accused was exoiteable. He did not smell his breath. The Magistrate: It’s rather extraordinary, isn’t it, that you did not make any tests? The Government pays lor a medical examination as to liquor. What was his condition? His sobriety was the point of issue. To Mr. Marsack: Pulse registration might have been due to excitement. He could not say definitely that accused, was under the influence of liquor. The Magistrate: Why did you give the certificate? Am I to take it that you arc going back on the certificate? Witness: In the circumstances I can’t say the condition was due to liquor. The charge was then dismissed.
