Hearing of Evidence In Court Discussed
OPINION OF MAGISTRATE "I do not agree with the Automobile Association taking evidence elsewhere. I would rather have it taken here.” stated Mr J. L. Stout, S.M., yesterday when?dealing with a by-law case.
"I would rather have a witness in the box. A great deal depends upon how they give their evidence and act there. .'A lot of untruths arc told in Court in connection with motor accident cases,” ho added. “To 1 ko (he evidence on commission •would be opening the door a bit wider.” This statement was made by Mr Stout during the hearing of a ease where a Wellington motorist was involved in a breach of (lie regulations in the city. Mr L. Abraham, appearing for defendant;, had staled that the Automobile Association (Wellington) had been of the opinion that, where the party or parties involved lived in another town, depositions of the evidence should be pcrmissablc, as unnecessary costs in travelling could be avoided.
