Tne Magistrate said the defenoe raisel was that the by-laws were ultra vires and unreasonable. After reviewing the evidenoe he had come to the conclusion that the restrictions were unreasonable. Regarding the legal aspeot he said it was not at all dear that the Boro?gh Oomcil had power $o limit the hours during which stook- might be r-riven along t;?e streets Power was given un"ier seotion 844 (2) of the Municipal Corporations Aet to prescribe a route by which cattle might be driven, but nothing was said about times and any power to make by-laws as to time was bv inference only from other sections. All the informations were dismissed. Counsel for the Borough Council said that he couU not at this stage definitely state that an appeal be made but be asked that in oase of an appeal the amount of the security required should be stated. The amount was fixel at £5 5s for each case.
