SUPREME COURT.
CASES HEARD TOGETHER. Two cases were heard in conjunction in the Supreme Court, on Friday, by His Honour Mr Justice Blair, in regard to a deceased person's estate. The parties were Mrs Annie Thomas, widow, who was plaintiff against William Pickett. George Henry Bryant, and Annie Thomas (executors under tho will of the late William Thomas, farmer, deceased) and Walter Henry Joseph Thomas, farmer, Ruby Olive Maud Montgomery and Alary Elizabeth Jane Holden. The three lastnamed are children of deceased’s former marriage, Airs Montgomery resides at Paremata and Airs Holden at Wollongong, Australia. The other parties all live at Rakaunui. One action sought a declaration that a cheque lor £SOO given by deceased to his wife in October, 1938, post-dated to November 2G, 1939, when a bank deposit fell due, was a gift. 1110 other was an application by the widow for further provision out of the estate, which was valued for probate purposes at between £3OOO and £4OOO. I3y bis will deceased left the sum of £2OOO to be invested and the income paid to the widow during her life, a.nd the capital to her child (Harold Thomas, now an infant ad litem) after her death. The balance of the estate, approximately £2500, was loft to the three children of the first marriage. Air J. S. Hanna (Wellington) appeared for plaintiff. Air J. P- Tunes for the infant child, AH N. 11. Rawson (Pahiatua) for the trustees, and AD- A. Af- Ongley for the three children of the first marriage. The case was adjourned after a lengthy hearing to allow the parties concerned to draw up the terms of a settlement.
