WARDEN'S COURT.

THUK3DAY, NOVMJIBEB Bth, 1877. (Before E. Shaw, Esq., Warden.) DAUNTLESS EXTENDED COMPANT. This wus an amplication by tho Company for protection of their mine. The case was partly heard at the last sitting of

ac Court, and adjourned for the purpose i if having a plan of the mine works pre- j jared, and also for the prepartion of an , iffldavit setting fourth, more fully the ; avidence in support. Mr Staite, who appeared for the Corn* pany, said he was prepared with the plan af the workings, but Mr Perrotti, who was a large shareholder in the Company ond one of the direotors, had telegraphed from Greymouth saying tbat certain papers in tbe case had been posted at Greymouth and were now en route, Under these oiroumstanoeß he (Mr Staite) asked that the further hearing of the application should be adjourned until the next sitting of the Court. Case adjourned until Tuesday next. EL DOEADO COMPANY. Mr Pitt, on behalf of this Company, applied fir two months' protection of the company's mine at Boatman's. He presented affidavits setting forth the grounds of the application. Protection, he said, bad been granted to the Company on a former occasion upon facts then adduced upon affidavit j that protection had now lapsed, and an extension of protection was now sought! The Company was one of the oldest in that part of the district, and had expended £7,313 in opening tbe mine. The main facts in support of the application had been adduced in affidavit on the former application, and tho present affida. vit merely carried the facts from that date to the present time, The Warden said that tho former pro. techon was granted on the 7th of August 1877, for a term of two months. How was it that such a lapse of time had occurred. The former application had ox* pired a month back. If a new rule was desired it should have been sought during tho currency of the former protection. It appeared that the mine bad been placed in danger for one month, and it was questionable now whether the application j should not bo ordered to be made de novo. Mr Pitt admitted that there had evidently been a laeh somewhere, but of that he knew nothing, having only recently been instructed in the case. The Warden said the application on general grounds was one worthy of con» sideration if only for the amount expended but it seemed that the Company had applied for two months' protection, and had taken three months's and now wanted two more which would make fivo months' in all, Mr Pitt said the driving in Walhalla tunnel had proved much harder thau was anticipated, and consequently the work was not so far advanced as was expected, as with the poet, " the bost laid schemes of mice and men gang aft agee." If protection was granted he had no doubt that before its expiration the Company would be ready to proceed with their operations. The El Dorado Companyhad three men employed upon tbeir lease the last three weeks. The Warden said it seemed that the El Dorado Company depended on the WaU bulla Company, and tho latter depended upon the Just-in-Time Company. If the case were adjourned more evidence would have to be adduced of the direction of the reef ana works iv the Just. in-Time and Walhalla mines. Mr Pitt conscntod to this course if pro* toction were grauted ad interim. Case adjourned till Tuesday next, pro, tecti^n to go in the meantime. C. Hogau applied for registration .of water race at Rainbow Creek, Devil's Creek. Soldiers. No objection, registration granted, for three heads of water. The Dauntless Extended Compauy applied for registration of water»raco from Murray Creek to machine site. Mr Byrne explained that the water was required to give additional power to the driving wheel of the Company's battery. It was the intention of tho Company, should sufficient inducement offer to erect an additional fivo heads of stampers. Registration granted, also registration of water right t.o drive hoisting gear, also registration of tramway, shoot, aud paddocks ; granted. Court adjourned.
