OFFENSIVE PREMISES WARNING UNHEEDED CASE HEARD IN PAEROA Charged that on May 30, 1949, he did suffer a nuisance to arise, namely an accumulation of rotten fish at the premises in Normanby road, Paeroa, known as the Regent Grillrooms, as to be offensive, Ivan Rodojkovich, restaurant proprietor of Paeroa, appeared before Mr W. H. Freeman, S.M., at the August sitting of the Paeroa Magistrate’s Court. Rodojkovich was also charged that on tie same date he did permit a dog to be upon the said premises, in particular in the smoke house of the said premises.

Mr C. N. O’Neill appeared for the informant and Mr D. G. Sinclair appeared for defendant, who entered a plea of guilty to both charges.

The offences were; said counsel, regarded as serious by the Health Department. It was hoped that the proceedings would bring about an amelioration of the conditions. Warnings did not seem to have any effect and as a result of warnings not being heeded proceedings had to be taken though in view of the fact that the proceedings were the first against the defendant a heavy penalty was not pressed for, said Mr O’Neill.

Mr Sinclair, for defendant, stated that defendant had given strict instructions that the dog was not to be let loose or allowed near the premises but during defendant’s absence the dog was let loose. With regard to the offal or offensive matter, the defendant was again, said counsel, away, and though he had given instructions that the offal was to be taken away the young man left in charge had not seen that the offal was taken away. “ It is remarkable,” said the magistrate, “ how many young people are to blame for everything that happens. It i|s always the fault of the young people.”

In respect of the first offence a fine of £3 was imposed ‘with costs 10s and solicitor’s fee £2 2s. In respect of the second offence a fine of £2 was inflicted with costs 10s and solicitor’s fee £2 2s.
