Wackrow of Taumarunui. the owner of the racehorse Boomerday, arising from an accident on the second day of the Taknpun.n meeting on December 1, Owing to heavy rain the first day an alteration was made in the course, part of whicl: was fenced by flagged posts. The horse in front of Boomer, day struck one of these posts, which broke. and a fragment struck Boomerday in the eye, the sight of which was destreyed. Plaintiff alleges negligence in fencing, which the club denies
