WAIPAWA.
(Own Correspondent.) An action for hearing in the Eketatahuna Magistrate’s Court, in which Mr. W. N. Waldin, of Makaretu, claimed damages in the sum of £2O 14/ from the Wai rar apa Farmers’ Co-op. Association, Ltd., has been settled by the defendants agreeing to pay the amount claimed and costs. Plaintiff instructed the defendant company’s agent at Eketahuna to purchase a certain line of lambs for him in January last, the. agent agreeing to do so, and signing the sale note in plaintiff’s name as purchaser. Delivery was subsequently diverted to another person altogether, and plaintiff claimed to have suffered loss to the extent of 4/ per head on the failure to deliver. Defendant company entered notice of defence on the grounds that there was no definite instruction to their agent to purchase the lambs, but prior to the hearing agreed to settle for the full amount claimed and costs. Mr. Strang appeared for plaintiff and Mr. T. M. Page for the defendant company.
