NEGLIGENT DRIVING CHARGE
MAN’S DEATH INVOLVED
YOUNG MAN FOUND GUILTY

HAMILTON, Aug. 26. A collision between two cars on the Morrinsville-Hamilton Road at New•stead on the evening of May 8, in which a young man, Thomas Shaw, was killed, led to the appearance of liis cousin, Hector John Shaw, aged 20, in the Supreme Court at Hamilton on a charge of negligently, driving a car so as to cause death. After a retirement of three hours the jury returned a verdict of guilty, with a recommendation for mercy on account of prisoner’s youth. Evidence showed that the road was clear and that both vehicles had a clear view of each other. Accused attributed the accident to his vehicle skidding through striking a pothole in the road. Sentence was deferred.

Charged with' negligent driving, causing death. Robert John Burling, aged 24. a. fartner of Parihaka-. near T’aumaVumii. appeared before the Otahu.hu Police Count to-day. The' charge arose out of an accident near Manurewa on August 2 when Charles Ben*y Simmons was killed.
The first witness said he board defendant say after the accident: “Poor Charlie, he was my best friend.” In a signed statement (produced), defendant said : “My mind was practically a. blank after I left Hamilton, and my first recollection is seeing my mate on the road after the accident. Burling pleaded not guilty, and was committed for trial. . . . The magistrate reserved Ms decision on a charge against Burling of being intoxicated while in charge of a car.
