The head office of the Rail ./ay Department was informed this morning that when the Limited Express which left Auckland yesterday was between Taonui and Bunnythorpe it struck a piece of firewood on the track- Tlieie was no damage. After investigation, it was found that the wood had fallen from a goods train. The incident was purely accidental, and in no way connected w'itli the recent attempts at train-wrecking. —Press Assn_ Reserved decision was delivered at New Plymouth Supreme Court iby MrJustice Reed, in the claim m which members of the Raukura tribe (iolilow - ers of To Whiti) proceeded against Ferini Te Whiti (daughter of the old chief) asking that 1a decilana.tion bemad© that certain moneys held by her were held as a trust on behalf of the Raukura: that she- he asked to account for the same; and that islie be removed from the trusteeship. In connection with the action a claim was put forward that she had fraudulently converted the money to her own use. It will he rememberedi that the hearing occupied the last sitting of the -Supreme- Count for -seven days and six evenings. His Honour .held that there was a trust, and that there Had been a breach of trust, and that on account of defen.dant’s defiance of the protest made on July 23, 1921, -she could not be isa-icl to have acted honestly and. reasonably, and was therefore not entitled to the protection of the Trustee Act His Honour himself found the amount dueto the trust to he £lBlO andi order ecT that this sum he paid into court within 30 days, to abide the further order of the court. An order for the payment of the costs of action by the defendant on the highest scale -ais on a judgment for £-1810 was also made.
