POWERS OF ARBITRATION COURT
A TEST CASE

WELLINGTON, April 6. The Full Court was occupied -.0-day in hearing a motion to have an award of the Arbitration Court quashed. The appellant is Richard Edwin Holloway, of New Brighton, grocer, and respondents Justice Fraser, Hiram Hunter, and William Scott, comprising the Court of Arbitration.
The facts are that on November 26, 1923, the Court made an award, entitled the North Canterbury Grocers’ Assistants and Drivers Award, which came into force on December and continues in force except as varied by .''he Court after the award, came into force.
The case was stated at the request of an inspector and was submitted to the Court of Appeal for an opinion. On Novemiber 27, 1924, in consequence of an expressed opinion, the award was varied in numerous details.
The- appellant stated he had been advised bv coun-sej that the Court of Arbitration has no jurisdiction to make an amending order based on opinion of the Court of Appeal, and these proceedings are made with a view to having sfleh ah order quashed. Mr. Cuthbert appeared for the plaintiff, and Mr. Donnelly for the defendant.
