CUY TELEGRAPH —PRESS ASSOCIATION. WELLINGTON, Nov. 17. ‘‘The attitude of the defendant subsequent to the proceedings being considered is a matter which I am bound to take into consideration. He appears to have been not frank with the department,” remarked Mr. E. Page, S.M., in the Magistrate’s Court today, in reference to George Bagley, manager of Young’s Chemical Company, against whom the Health Department took proceedings for selling vanilla essence without exhibiting a conspicuous printed notice describing its composition.
was alleged by the department, tor whom Mr. Macassey appeared, that the defendant had used synthetic vanilla, made from oil of cloves or in some other way, and not alcoholic extract of vanilla. Mr. Bean, for the defendant, pleaded not guilty when the case came before the court on Friday; but Mr. C. G. White intimated this morning that a plea of guilty would be entered. Counsel submitted that the defendant had no intention of defrauding his customers, and it wa s with the object °u them a finer or more palatable flavouring that the process was used.
A fine of £IOO and costs was imposed.
