Friday, March 33. ;(Before Mr Warden, Whitefoord.) Michael Cassidy v . William Green way. '— The plainjiff claimed L2O as. the price of a share alleged to be purchased by; the .defendant in a mining claim at Half-Ounce, and L 5 as working expenses; connected therewith. The plaintiff also requested the Court to dissolve the partnership'be^tween the co-adventurers. : The plaintiff said the defendant purchased the share on condition that if it paid a certain wage per week the price charged should be paid out of the proceeds.; . The defendant admitted this, but denied that the claim had paid the = amount- stated per week...'; Evidence was given to show that the claim did pay, and a verdict was given -for the amount claimed with costs j the money to be ! paid in instalments of L 3 per week. Mr Staite for the plaintiff. ; ' Daniel Rielly and Joseph Cleary, applied for two and a half acres auriferous ground as | a special claim at the; right fork of Noble's Creek! ; The application was opposed by Matthias Willing, Juliahßathe, and Ward Holroyd, on the ground-T-lst. That they intended to briug water on to the range on which ihe grant was applied for. 2. That the grant would monopolise a large area of known payable ground. 3. That no special outlay would have to be made by the applicants to entitle them to the grant; and lastly. That the ground could be profitably worked in ordinary claims. Objections were also lodged by Mr Henry Lash on the grounds — Ist. That he had a water-race which he intended to conduct to the place for which the grant was applied. 2. There wasnot any special difficulty in working the ground at present.: 3. The ground would pay to work in ordinary areas. 4. The ground would be a monopoly, aDd practically shut a much larger extent of ground thim that applied for. After considering the objections and hearing evidence in support of them, the Warden held them to; be good, and refused the area applied for on public grounds, but offering the applicants a reduced area of one acre, provijied three ; men were employed upon it henceforth. ■ . ' jFrancis Grogan and party applied for a dam site iti Qreek'fj Gully, Big River, Granted. ; .Geo. Cole applied for a residence area at' Callaghan Creek. Granted. jMarshall and Roscan were granted protection for their claim and property at Brown's Terrace for three months, work being discontinued owing to pecuniary impediments. iThe Court adjourned to March 20. /
