A PECULIAR CASE.

ASSETS COMPANY WANT THEIR MONEY BACK. [By Tej/graph —Press Association.]

Dunedin, last night,

The preliminary phase of an unusual case came before the Suprem e Court in banco. The Assets Company, formed in Edinburgh to take over the assets of the Glasgow Bank, commenced with a capital of half a million. The agent in Now Zealand had therefore to pay a fee of £2OO per annum to carry on business. The capital was subsequently reduced, and the fee payable would only amount to £SO ; but the New Zealand agent was not informed of the change, and for ten years went on paying £2OO, thus contributing £ISOO unnecessarily to the revenue of the colony. It is now proposed to sue the Crown to recover this amount. The question argued to-day was whether the claim was barred by the statute of limitations or the Crown Suits Act, on which point decision was reserved.
